The Workers Compensation and Rehabilitation (National Injury Insurance Scheme) Amendment Bill 2016 was passed by the Queensland Parliament on 31 August 2016.

The Act aims to achieve the following:

  1. It introduces into the worker’s compensation regime the necessary steps to implement the National Injury Insurance Scheme similar to that introduced earlier this year in relation to motor vehicle accidents.
  2. It reverses the effect of the decision in Byrne v People Resourcing (Qld) Pty Ltd & Anor [2014] QSC 269 - to deal with the impact of “hold harmless clauses” in contracts.
  3. It provides greater flexibility and choice for self-insurers with respect to the guarantee of solvency.
  4. It clarifies the time frames for prosecution of fraud.

It changes how compensation and damages payments are to be indexed.
