The Workers Compensation and Rehabilitation (National Injury Insurance Scheme) Amendment Bill 2016 was passed by the Queensland Parliament on 31 August 2016.
The Act aims to achieve the following:
- It introduces into the worker’s compensation regime the necessary steps to implement the National Injury Insurance Scheme similar to that introduced earlier this year in relation to motor vehicle accidents.
- It reverses the effect of the decision in Byrne v People Resourcing (Qld) Pty Ltd & Anor  QSC 269 - to deal with the impact of “hold harmless clauses” in contracts.
- It provides greater flexibility and choice for self-insurers with respect to the guarantee of solvency.
- It clarifies the time frames for prosecution of fraud.
It changes how compensation and damages payments are to be indexed.
