Can an injured worker receive permanent total disability and permanent partial disability benefits from the same incident? In a word, Yes – at least according to one Ohio appellate court. The court found that a claimant who injured her lower back while working as a health aide could receive both awards because the psychological condition that gave rise to the permanent total award was different from the physical condition that led to the permanent partial award. This is true even when the psychological and physical conditions occurred during the same workplace accident. The court made an important distinction. A claimant can receive permanent partial disability benefits and permanent total disability benefits for different injuries, but a claimant cannot receive both awards for the same injury.
