On 22nd the Government published the Command Paper “Scotland in the UK”, implementing the Smith Commission’s recommendation (subject to consultation) that the Copyright Tribunal’s functions should be transferred to a Scottish tribunal.

The Tribunal will not immediately be affected as the draft legislation only sets out the powers that could effect the transfer, rather than effecting the transfer itself. The jurisdiction of the Copyright, Designs and Patents Act 1988 will not be altered by the transfer.
