Under current practice, an applicant filing under the AEP in Category 3 (i.e., the invention patent application is essential to commercial exploitation) must provide an explanation sufficient to show the commercial (trading) acts in respect of such application, and must present relevant evidence, such as product photographs, commercial catalogs, license agreement, etc.  The TIPO announced on December 3, 2015 that the types of commercial (trading) acts for applications under Category 3 also include inventions arising from cooperation among industry and educational institutions, research organizations, etc.  Regardless of whether the applicant is in the name of an individual, school, research organization or company, and regardless of whether the funding source is from government or private sources, an application may be filed under the AEP in Category 3 as long as there is a cooperative relationship.
