Cyclist receives six-figure compensation payment after a serious road collision whilst out training
A 53 year old man from Chigwell who suffered serious injuries when he was knocked off his bike in June 2014 whilst out on a training ride near Epping Forest has received a six figure settlement.
Robert Butler, head of a trading floor in the City, was cycling along the A104 when a car coming from the opposite direction turned across his path to enter a side road.
Mr Butler collided with the rear side window of the vehicle. Despite it being in daylight, on a summer’s evening, the driver claimed not to have seen Mr Butler who suffered serious facial injuries caused by glass from the car’s window along with further injuries to his shoulder, back, lungs and ribs.
The air ambulance attended. Mr Butler was admitted to the Royal London Hospital in Whitechapel for 10 days, undergoing several operations under the care of the trauma team and specialists there.
He remained off work for several months.
On recommendation from a cycling friend Mr Butler instructed law firm Leigh Day, lawyers from the firm liaised with his medical team, an eminent neuropsychologist, his employers and family.
After re-negotiating and initial offer from the defendants insurers, Leigh Day resolved Mr Butler's case in March 2015.
As part of the settlement Leigh Day were able to secure compensation to repay Mr Butler’s employer the sick pay they had paid him during his absence from work.
Mr Butler said: “My employers had supported me throughout this ordeal, so I was really pleased to be able to repay them.
“The settlement was earlier than predicted but I was very pleased with the outcome and felt that all future potential complications had been investigated and ruled out.
“Despite suffering serious and potentially life altering injuries, I am fortunate enough to have made a good recovery although as yet I am not back on my bike.
Rachel Botterill a lawyer in the cycling team at Leigh Day, who looked after Mr Butler’s claim and his care, said:
“This was a significant road collision. Mr Butler was knocked off his bike by a car in broad daylight when he was there to be seen. He sustained multiple injuries which caused him a great deal of pain and his family a great deal of anxiety.”
