TTB label approval is generally required only when an alcoholic beverage is going to cross state lines (see 27 C.F.R. §7.20). Meanwhile, the New Jersey Division of Alcoholic Beverage Control (ABC) requires that all brands sold in New Jersey be registered with the ABC (see N.J.S.A. 33:1-2 and N.J.A.C. 13:2-33). The New Jersey ABC, however, will not process a brand registration unless the brand has received TTB label approval – the instructions to the New Jersey ABC brand registration form say as much. So, even though the TTB will not require a brewery to obtain a COLA for strictly intra-state New Jersey sales, the New Jersey ABC will. Said another way, if a brewery is selling product in New Jersey only, its brands still need a COLA from the TTB because that is a prerequisite to obtaining brand registration with the New Jersey ABC.
