Following up on our earlier entries regarding the constitutional challenge playing out in a New Jersey district court about the constitutionality of the Professional and Amateur Sports Protection Act ("PASPA") -- the result of which will determine the fate of sports betting in New Jersey -- today the US Department of Justice filed notice of its intention to intervene in the case in order to defend PASPA's constitutionality.

The DOJ's notice does not contain any substantive argument, but requests until February 1, 2013 to submit a brief, and requests to participate in oral argument, which is currently scheduled for February 14, 2013.
