On 1 October 2015, an amendment to the Austrian Copyright Act came into force, imposing copyright levies for all storage media. The levy has to be paid by the importer of the storage media. On 6 November 2015, the specific amounts of these levies were set in negotiations. They range from EUR 0.35 for external memory cards to EUR 5 for integrated computer hard drives.
The old copyright regime applied only to blank tapes, CDs and DVDs. The new regime covers any kind of storage media including USB flash drives, computer hard drives, and smart phone memory. In a recent case, the Austrian Supreme Court held that the method of distribution of the levies violates EU law, making it impermissible to collect the levies. Whether this deficiency was corrected by the latest amendment is still hotly debated.
