The European Commission has put two Czech companies on notice of potential fines in relation to allegations that they obstructed an inspection by competition officials in November 2009 into potential antitrust infringements in the Czech electricity sector. The details are set out in a Statement of Objections sent to Energetický a průmyslový holding and J&T Investment Advisors on 20 December 2010. At issue are the allegations that, during the investigations, there was a failure to block an e-mail account, failure to open encrypted e-mails and the diversion of incoming e-mails. The companies concerned will have an opportunity to respond to the allegations before the Commission reaches a definitive view on the matter and whether to penalise the companies.
