On March 17, 2010, the Therapeutic Products Directorate released its annual report for the year 2008 on the Patented Medicines (Notice of Compliance) Regulations (“PMNOC Regulations”). This report includes information on the number of patents added to the Patent Register in any given year. Also, the report provides some information as to the breakdown of patents listed for different medicines. The application also gives steps as to the results of proceedings started under the PMNOC Regulations. This demonstrates that the document also sets out average time to resolution of proceedings under the PMNOC Regulations.
This year’s report also provides statistical information about innovative drugs which have been put on the Innovative Drug Register and ongoing judicial review applications involving the Data Protection Regulations.
