The CEDR Commission was established to review the facilitation of settlement by international arbitral tribunals and to come up with recommendations to improve this aspect of the process for end-users. The Commission's co-chairs are Lord Woolf of Barnes and Professor Gabrielle Kaufmann-Kohler.

The Commission consulted with various arbitration practitioners in 2009 with a view to developing rules designed to increase the prospects of parties to arbitration proceedings being able to settle their disputes. The Commission published a draft report and rules in the summer of 2009 on which further comments are being sought. Herbert Smith is a member of the Commission with partners Paula Hodges and Matthew Weiniger (London) and Graeme Johnston (Shanghai) involved in the consultation.
