Spain - The CNMC initiates disciplinary proceedings against five companies for irregularities in the use of numbering resources Five companies have been penalized by the Spanish National Market and Competition Commission (CNMC) for the use of Premium SMS numbers for purposes other than those declared in their requests. Instead of providing the downloadable content (i.e., a ringtone) upon receipt of a user's SMS, these companies instead started conversations with various users with the objective of increasing the number of Premium SMS exchanged. As such, sanctions were imposed on these companies, which varied depending on the amount of Premium SMS numbers used, the amounts received as a result of such infringement and the time period of the infringement. Failure to comply with the conditions for the numeration assignment is a "serious infringement" under the General Telecommunications Law.
