Employers could see an increased focus on Department of Labor investigations in the workplace. While the ability to conduct these investigations is not new, the DOL’s exercise of this power is expected to increase in the coming year. The DOL can conduct an unscheduled investigation at an employer’s workplace at any time and investigators are not required to disclose the reason for an investigation. The increase is due in part to the DOL’s concern with employers’ Family and Medical Leave Act policies. These investigations can lead to a burdensome review of documents, consumption of time and the potential payment of penalties. FMLA-covered employers should consider reviewing their FMLA notices, forms and recordkeeping documents.
