In addition to federal guidelines, states are creating their own rules and guidelines for bathroom use. The Department of Justice recently sent a letter to North Carolina Governor Pat McCrory denouncing the Tar Heel state’s controversial law that bans people from using public bathrooms that don’t correspond to their biological sex. The DOJ believes North Carolina’s bathroom law violates Title VII of the Civil rights Act and is facially discriminatory against transgender employees because it treats transgender employees differently than similarly situated non-transgender employees. Governor McCrory believes the DOJ is overreaching and that North Carolina’s bathroom law will have an important, far-reaching impact. Stay tuned.
