On March 11, 2015, the U.S. International Trade Commission ("Commission") issued a press release announcing their vote to institute an investigation of Certain Toy Figurines and Toy Sets Containing The Same (Inv. No. 337-TA-948).
The investigation is based on a February 6, 2015 complaint filed by LEGO A/S of Denmark, LEGO System A/S of Denmark, and LEGO Systems, Inc. of Enfield, Connecticut alleging violation of Section 337 in the importation into the U.S. and sale of certain toy figurines and toy sets containing the same that infringe one or more of the following U.S. design patents: D682,367; D678,432; D689,568 ; and D672,413 as well as one or more of the following U.S. Copyright registrations: VA 1-876-291, VA 1-876-279, VA 1-876-378, and VA 1-876-373. According to the Notice of Investigation, the Commission has identified LaRose Industries LLC d/b/a CRA-Z-ART of Randolph, New Jersey, MEGA Brands Inc. of Canada, and Best-Lock Construction Toys, Inc. of Miami, Florida as respondents in this matter.
Lastly, Chief ALJ Bullock issued a notice indicating that he will be the presiding Administrative Law Judge in this matter.
