Under the new Hungarian Civil Code, entered into force on March 15, 2014, in case of a lease, if the lessor transfers ownership of the leased property after the conclusion of a lease agreement through an asset deal, the rights and obligations of the owner arising out of or in connection with the lease agreement will transfer to the new owner. However, the lessor (previous owner) and the new owner shall be jointly and severally liable toward the lessee for the lessor's obligations arising out of or in connection with the lease agreement. The previous owner liability can be excluded upon agreement with the lessee; but, it is not clear yet whether this provision applies to only leases concluded after the new Civil Code entered into force or also to leases concluded before the new Civil Code entered into force, but the actual transfer of which did not occur until after the new Civil Code entered into force.
