The Alternative Dispute Resolution for Consumer Disputes (Amendment) Regulations 2015 (SI 2015/1392) have been published which amend the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015 (SI 2015/452) (ADR Regulations), which implement the majority of the ADR Directive (Directive 2013/11/EU on alternative dispute resolution for consumer disputes).
The amendments to the ADR Regulations include:
- Removal of the requirement for an ADR entity to be established in the UK.
- Various obligations on ADR entities regarding the information they must provide to parties if the outcome of the ADR procedure is to be binding.
- A provision enabling the FCA to make rules to charge fees to the FOS for its functions as a competent authority.
