The TIPO promulgated the amended Substantive Examination Guideline of Design Patent, which became effective on April 1, 2016.  In order to conform to Para. 2, Article 136 of the Patent Act, which stipulates that “the extent of the protection conferred by a design patent shall be determined by the drawings”, the amended Substantive Examination Guideline of Design Patent provides that if the designs do not claim colors, they can be disclosed only by ink drawings, grey-scale computer-generated drawings or black-and-white photographs.
