The OFT has issued a Statement of Objections (SO) alleging that employees at Virgin Atlantic and Cathay Pacific Airways exchanged commercially sensitive information on pricing and other commercial matters in relation to passenger services on the London to Hong Kong route. The OFT alleges that the airlines have engaged in price fixing in breach of EU and UK competition rules. It was alerted to the matter by Cathay Pacific under its leniency policy. Provided Cathay Pacific continues to cooperate with the investigation, it is likely to qualify for full immunity from any eventual fines. In any event, the investigation is far from reaching a conclusion. The parties now have the opportunity to respond to the allegations and third parties with an interest in the case may also comment before any final decision is taken
