The Department of Defense, the General Services Administration, and NASA have proposed to amend the Federal Acquisition Regulation (FAR) to prohibit the use of funds for a contract with any entity that requires employees or contractors to sign a confidentiality agreement restricting their ability to report fraud to the government.  Federal Acquisition Regulation: Contractor Employee Internal Confidentiality Agreements, 81 Fed. Reg. 14, 3763 (proposed Jan. 22, 2016) (to be codified at 48 C.F.R. pts. 3, 4, and 52).  The proposed FAR provision notifies contractors of the prohibition on the use of funds for the contract if the contractor is not in compliance with the requirements of the clause.  The proposed clause also requires that contractors notify their employees that any pre-existing confidentiality agreements are no longer in effect.
