Despite market concerns the Solicitors Regulation Authority (SRA) has confirmed they have "no intention of lifting the cold calling ban for solicitors working in personal injury and will make that clear in the final codes".
In a move to drastically slim down the handbook, a draft of the new Code of Conduct was recently published and eagle eyed lawyers were quick to point out "rule 7" on the prohibition of cold calling was removed in its entirety.
The Association of Personal Injury Lawyers (APIL) was strongly against the action as they believed the move would reduce consumer protection as some solicitors would be liable to contact people without their permission.
Simon Trott, founding member of Ethical Marketing Charter, also expressed his disagreement with the removal of the rule stating it undermined the fundamental principles of the charter; that being signatories to the charter are never to cold call members of the public.
Cold calling directly impacts on the number of opportunistic fraudulent claims that are made, therefore the prohibition will help to keep these to a minimum.
