A photograph taken by a police helicopter camera of the comedian Michael McIntyre in central London was tweeted by the National Police Air Support Unit this week.

The ICO are now investigating whether this could be a potential breach of the Data Protection Act 1998 if there is no legitimate purpose for processing the personal data and for disclosing the image.

In response a Metropolitan Police spokesperson released a statement outlining that "this tweet does not, as far as we know, constitute a breach of data protection legislation", adding that it "was deleted due to due negative responses on Twitter".
