The Competition Commission has referred a case of indirect price fixing and market division against Natal Portland Cement (NPC) to the Tribunal. The referral follows an investigation (between 2008 and 2012) into collusion amongst NPC, Pretoria Portland Cement Company (PPC), Lafarge Industries South Africa (Lafarge) and AfriSam Consortium (AfriSam). AfriSam and Lafarge have settled with the Commission and agreed to pay an administrative penalty whereas PPC was granted conditional leniency in terms of the corporate leniency policy. NPC has not settled with the Commission. The matter concerns the exchange of competitively sensitive information through the auditors appointed by the Cement andConcrete Institute (C&CI).
