Food:

  • On August 18, the China Food and Drug Administration (CFDA) issued the revised draft of “Measures for Supervision and Administration of Online Food Business.” Public comments are due by September 18. The Measures comprise of 47 articles in 6 chapters, including the obligations of online food operators, obligations of 3rd party platform providers for online food transactions, and online food business activity supervision and administration. According to the Measures, food operators may conduct food business operations online by setting up their own websites or via 3rd party platforms for online food transactions. Providers of 3rd party platforms for online food transactions should establish and implement administrative systems, e.g. operator review and registration, food sales information audits, internal transaction management rules, food safety emergency response procedures, complaint processing, and consumer protection in line with relevant food safety requirements, to ensure the safety of food products.
  • On August 18, CFDA issued the revised draft of “Measures for Supervision and Inspection of Food Production and Operation.” Public comments are due by September 18. The Measures comprise of 40 articles in six chapters, including general principles, the responsibilities of food producers and operators, contents and requirements of supervision and inspection, procedures of supervision and inspection, and legal liability. 

Chemicals:

  • On August 25, the Ministries of Transport (MOT), Environmental Protection (MEP), and Industry and Information Technology (MIIT), and the State Administration of Work Safety (SAWS) jointly issued the “List of Hazardous Chemicals Prohibited from Inland Waterway Transport (2015 Trial Version).” The list is a subgroup of the Inventory of Hazardous Chemicals (2015) containing all the 148 “highly toxic chemicals” specified by the Inventory and 160 other hazardous chemicals.
