Implementation of the above legislation is not likely now to happen until 2013. When implemented, the 2010 Act will replace the Third Parties (Rights against Insurers) Act 1930. The 2010 Act will allow a person with a claim against an insolvent person to proceed against the insolvent’s insurer directly, without first establishing the liability of the insolvent person.
