In May 2011, a San Francisco Superior Court Judge struck down CARB’s environmental review of its AB 32 Scoping Plan. The Judge found, among other flaws, that CARB had not studied alternatives to its Cap and Trade program adequately. Although CARB appealed the Judge’s ruling, at the same time it proceeded with new environmental review that sought to address the Judge’s concerns. Last week the public comment period on that environmental review closed and CARB approved the new environmental review.
