The House of Commons Justice Select Committee has decided to hold an inquiry into the effects of the introduction of Employment Tribunal fees in 2013. It will also consider the levels of those fees. The fees are currently:

  • Issue fee – simple claim (e.g. unlawful deduction from wages) - £160; complex claim (e.g. unfair dismissal, discrimination) - £250
  • Hearing fee – simple claim - £230; complex claim - £950.

The Committee is particularly interested in addressing whether the introduction of employment tribunal fees has:

  • affected access to justice
  • affected the volume and quality of cases.

Here at Penningtons Manches, we have seen both the volume of claims decline and a sharp reduction in the number of fairly dismissed employees who submit rushed, poor quality claims in the hope of a pay-out.
