ESMA has published a call for evidence on asset segregation and custody services under AIFMD and UCITS V. Implementing measures under UCITS V have recently introduced asset segregation requirements under the UCITS framework that are broadly aligned to the AIFMD and asset segregation issues have therefore become a horizontal matter relevant to both AIFs and UCITS. As a result, ESMA has decided to carry out a further consultation aimed at: (i) gathering further evidence on the arguments set out by the majority of respondents to its December 2014 AIFMD consultation on this issue; and (ii) broadening the scope of this work to cover also the UCITS V asset segregation rules. Comments are invited by 23 September 2016.
