On February 13, 2016, through the Government Agreement No. 33-2016, amendments to Occupational Health and Safety Regulations (Governmental Agreement No. 229-2014) entered into force.
In accordance with Article 10 of the regulation aforementioned, to ensure Occupational Health and Safety in the workplace, a bipartite committee shall be established, composed by equal numbers of representatives of employers and employees.
It is established that both, the conformation of these committees and the corresponding book of minutes, shall be authorized by the Occupational Health and Safety Department of the Ministry of Labor and Social Security of Guatemala.
It is relevant to indicate that the attributions or functions of the committee shall be developed in the Internal Work Regulations frame, which requires all employers, with a number of ten or more employees to carry out these incorporations.
It shall be established within the functions of the committee, the management of occupational risk prevention and the collaboration on inspections conducted by the Occupational Health and Safety Department of the Ministry of Labor and Social Welfare of Guatemala together with the Safety and Hygiene Section of the Guatemalan Social Security Institute.
