On 14 February 2012, the European Court of Justice (“ECJ”) responded to a preliminary reference from the Czech courts. The ECJ held that Article 101 could not be used by national authorities to impose a fine on a cartel in respect of an infringement which occurred in a state prior to that state joining the European Union.
