The Hamburg Data Protection Office, the competent body for the control of Facebook in Germany, announced that it is examining the legality of Facebook’s new privacy policy. The Office has questioned whether there is a legal basis for the exchange of member data with third party companies, allowed for in the policy. It has also stated that it is unlikely that the policy complies with the principles of data avoidance and data economy required by German privacy law or that consent obtained from its members can be considered valid.
