The Supreme People's Court ("SPC") has issued the Several Provisions on the Enforcement of Property Involved in Criminal Judgments (the "Provisions"), with effect as of November 6, 2014.

The Provisions require that where certain property is ruled to be confiscated under a criminal judgment, the specific property or a specific amount subject to the confiscation shall be specified; where certain property is ruled to be recovered or ordered to be compensated for, the amount subject to the recovery or compensation, or the name, quantity, etc. of the property shall be specified; and where certain property is ruled to be confiscated, the property subject to enforcement shall be the property legally owned by the person subject to the enforcement at the time when the criminal judgment takes effect.

It is emphasized that where property confiscation or a fine is subject to enforcement, the necessary living expenses for the person subject to the enforcement and his/her dependent family members shall be reserved with reference to the minimum living standard of the preceding year for local residents which is published by the government at the place where the dependents have a domicile.
