U.S. Immigration and Customs Enforcement (ICE) and the Office of Special Counsel for Immigration-Related Unfair Employment Practices (OSC) recently issued joint guidance to employers conducting internal Form I-9 audits. The guidance provides critical information for employers to ensure that their internal I-9 audits are conducted fairly and accurately, without discrimination or retaliation. It covers topics like: avoiding discriminatory and retaliatory audits, correcting errors and omissions, curing E-Verify mistakes and the discovery of unauthorized workers. This guidance is important.
