In Earls v The Financial Service Ombudsman & Anor [2015] IEHC 536, the High Court of Ireland overturned a Financial Services Ombudsman (FSO) finding that an insured had failed to disclose a material fact in their insurance application and remitted the case to the FSO for (re)consideration. In coming to its decision, the Court carried out a case law analysis on non-disclosure in insurance applications and the principles to be applied.
