Further to our May 15, 2015 reminder, some U.S. persons with foreign affiliates that missed the May 29, 2015 deadline for filing the Benchmark Survey of U.S. Direct Investment Abroad (“BE-10 Survey”) are eligible for an extension with the U.S. Department of Commerce Bureau of Economic Analysis (“BEA”). “New filers” now have through June 30, 2015 to complete the BE-10 Survey. This extension is available to U.S. persons that are required to file a BE-10 Survey, but that have never filed any BEA survey of U.S. direct investment abroad, including the BE-10, BE-11, and BE-577.

Forms may be submitted online using the BEA’s secure e-File system, faxed to (202) 606-5312, or mailed to the BEA at the address listed on the Form BE-10A. Parties that have not yet set up an e-File account can do so using these directions. These e-File accounts take two-to-three days to set up, and the BEA suggests that new filers with fewer than five foreign affiliates submit their forms by fax or mail to avoid this delay. New filers with five or more foreign affiliates can contact the BEA at (202) 606-5566 with questions regarding the e-File system.
