The government has revealed that, from the Autumn, all new Employment Tribunal judgments will be published in an online searchable database, accessible to the public. A decision has not yet been reached as to whether existing judgments will also be added to the database.

The media will probably take a keen interest in the contents of the database and cases that might otherwise have gone unnoticed could attract publicity. This could encourage some parties to settle claims they might otherwise have fought.

Also later this year we are expecting an ‘early neutral evaluation’ process to be introduced to Employment Tribunal proceedings in England and Wales. The idea is that, where the parties agree, an Employment Judge will be able to explore and comment on the apparent strengths and weaknesses of each party’s case with a view to helping the parties to reach a settlement.
