CMA has published on MoU establishing a framework for cooperation between CMA and FCA on the use of concurrent powers under consumer protection legislation. The powers come from the Consumer Rights Act 2015, the Unfair Terms in Consumer Contracts Regulations 1999 and legislation enforceable under Part 8 of the Enterprise Act 2002, including the Consumer Protection from Unfair Trading Regulations 2008. The MoU sets out each authority’s role, and explains their intention to work together to make financial markets work well for consumers. An MoU entered into by FCA and CMA relating to concurrent competition powers was published in December 2015 (see FReD 23 December 2015). (Source: MoU Between CMA and FCA on Consumer Protection Powers)
