Packaged as a clarification, modernisation and simplification of the law of contracts, which has not changed since 1804, Ordonnance n° 2016-131 dated 10 February 2016 for the reform of the law of contract, the general regime of obligations and proof of obligations (the "Ordonnance") is more of a codification of existing jurisprudence than a rewriting of the law. Whilst some new concepts are introduced into the French Civil Code, the principle of freedom of contract is retained and only a few provisions are of public policy.

The aim of this e-briefing is to set out, in the form of a table, the main changes introduced by the Ordonnance. It is not intended to be an exhaustive review of the new provisions.
