Bayer Healthcare LLC, et al. v. Mylan Pharmaceuticals, Inc., C.A. No. 15-114 - LPS, March 30, 2016.

Stark, C. J. Defendant’s motion to dismiss for lack of personal jurisdiction is denied without prejudice to renew should the Federal Circuit or Supreme Court materially change the law on appeal.

The court previously concluded it could exercise general jurisdiction over defendant. A ruling on appeal in Accorda Theraputics affirmed general jurisdiction over this defendant. The court denies defendant’s motion to dismiss in this case with leave to renew in the event further appellate proceedings results in a material change in the law.
