On 6 April 2015, the new CDM Regulations 2015 (the “Regulations”) will come into force. The Regulations set out the legal duties for the safe operation of construction sites by placing duties on clients, designers and contractors, to plan their approach to health and safety.
A copy of the Regulations and guidance is available. Any building contracts which are entered into after 6 April will be subject to the Regulations. If a building contract has been entered into before 6 April then the transitional provisions contained in regulation 37 will apply.
The Regulations bring in various changes including the replacement of the CDM Co-ordinator with the role of Principal Designer, an increased duty on the Client to ensure its Contractor complies with the Regulations and a modification to the requirement of when a project must be notified to the Health and Safety Executive.
