Giovanni Buttarelli, the European Data Protection Supervisor (EDPS) has given an interview regarding the CJEU’s ruling on Safe Harbor. The EDPS notes that the ball is now in the court of the data protection authorities in the Member States, as they will be the ones to enforce the law, so it is important that there is a unified approach. The EDPS also stated that while the alternative approaches such as model clauses and consents are not directly affected by the ruling, these legal instruments need to be analysed. The EDPS did not rule out that such model clauses could be amended. The issue is currently with the Article 29 Working Party whose exceptional meeting will be particularly important.
