Amendments to the list of foreigners who can work in Azerbaijan without obtaining a work permit have been introduced into the Migration Code of the Republic of Azerbaijan and came into effect 2 June 2016.

Pursuant to the amendment, the list of persons, who can work in Azerbaijan without obtaining of a work permit, now also includes:

  1. Directors and deputy directors of a legal entity incorporated in Azerbaijan and having a foreign legal entity or a physical person as at least one of its shareholders; 
  2. Specialists in categories determined by the respective state body and invited by legal entities incorporated in the Republic of Azerbaijan or citizens of the Republic of Azerbaijan for the purpose of rendering services or performing works in fields determined by the respective state body.

Foreigners coming to Azerbaijan on the above-mentioned grounds are exempt from the requirement to obtain work permits and, moreover, are entitled to obtain temporary residence permits for the period of their work in Azerbaijan, subject to certain statutory limitations.

It is noteworthy that, before the introduction of this amendment, only directors and deputy directors of branch and representative offices of foreign legal entities in Azerbaijan were exempt from the requirement to obtain a work permit.
