The Hong Kong Privacy Commissioner has issued a revised Code of Practice on Human Resource Management and a revised Privacy Guidelines for Monitoring and Personal Data Privacy at Work.
Although there have been no material changes it is a useful opportunity for organisations to remind themselves of their content, which provides practical guidance to organisations that handle personal data for the purpose of performing human resources functions on how to comply with the data protection law in Hong Kong, the Personal Data (Privacy) Ordinance ("PDPO").
To the extent organisations process personal data in Hong Kong, particularly in pursuant to an employment relationship, they should reference the revised guidance to ensure they are processing such personal data in compliance with the PDPO.
