The Consumer Product Safety Commission (CPSC ) is seeking public comments on the process and substance of a review of its regulations required by an executive order issued July 11, 2011. 76 Fed. Reg. 64,865 (10/19/11). Executive Order 13579 directed independent agencies to develop plans for the periodic review of “significant rules that may be outmoded, ineffective, insufficient, or excessively burdensome.”
CPSC has previously conducted two reviews of its regulations; the first, from 2004-2007, examined regulations for consistency, currency and reduction of regulatory burdens; and the second featured a series of reviews conducted under the Regulatory Flexibility Act, which requires agencies to examine rules that have a significant economic impact on a substantial number of small entities. CPSC intends to conduct a broader review than those in the past and requests comments by December 19, 2011.
