Recently, the U.S. Department of Labor (“DOL”) announced the appeals process that individuals can use if they are denied the premium subsidy for their COBRA continuation coverage. The American Recovery and Reinvestment Act (“ARRA”) provides a 65% government-funded COBRA premium subsidy for individuals who were, or will be, involuntarily terminated from employment between September 1, 2008 and December 31, 2009. ARRA also required the DOL to establish an appeals process for those individuals denied the premium subsidy.

To appeal a premium subsidy denial, the individual must complete the DOL’s new application. The individual can download the application (www.dol.gov/ebsa/COBRA/main.html) or complete it online. The individual must answer all eligibility questions to the best of his or her knowledge and ability. The individual should attach all relevant documents to the application and include their contact information.
