Article 11(5) of the Labor Standards Law (the LSA) provides that an employer may serve advance notice of termination of employment if an employee is unable to fulfill his or her work duties.   As to when an employee should be considered to be unable to fulfill his or her work  duties,  the  Supreme  Court  explained  that  the employee’s  capability,  knowledge,  and  conduct  should be taken into account, as well as whether he/she violated the obligation to faithfully fulfill his/her responsibilities. Where an employee remains unable to fulfill his or her duties   even   after   the   employer   has   adopted   every safeguard          measure           provided          for            in         the       LSA,   the employer  may  serve  advance  notice  of  termination  of employment  in  accordance  with  Article  11(5)  of  the LSA.
