Google have been granted permission to appeal to the Court of Appeal by the Supreme Court in the Google v Vidal-Hall & Others case on two grounds; whether the Court of Appeal was correct that s13(2) of the UK Data Protection Act was incompatible with Article 23 of Directive 95/45/EC and whether the Court of Appeal was right to dis-apply section 13(2) on the grounds that it conflicts with the rights guaranteed by Articles 7 & 8 of the EU Charter of Fundamental rights.
