Bryan Dunne discusses a recent Employment Appeals Tribunal (“EAT”) ruling regarding an employee on long term absence. The EAT’s ruling gives some interesting insight into how the Irish courts might expect employers to manage an employee’s return to work and is also a rare example of an employer exercising a strategy of admitting the dismissal was unfair at the outset in order to limit the case to an assessment of loss of earnings only.
