The Brazilian Agency for Petroleum, Natural Gas and Biofuels (the "ANP") published on January 5, 2015, a draft Resolution concerning the review of ANP Ordinance No 170/1998, which establishes the rules for the construction, expansion and operation of facilities for movement of oil, oil by-products, and natural gas, including liquefied natural gas (GNL).
The draft Resolution also regulates the construction, expansion and operation of facilities or pipelines associated with the exploration and production of oil and natural gas which are not part of the areas under the concession contracts, used for oil and natural gas storage and transfer.
The facilities covered by the draft Resolution include all systems essential to its operation, such as pumping stations, storage tanks, compressor stations, delivery or receiving points of natural gas, measuring stations for operational purposes or transfer of custody, among others.
The natural gas transportation pipelines which are ruled by the draft Resolution, are limited to those under the authorisation regime, as set out in article 4 of Decree No. 7.382/2010, which regulates the article 3 of Law No. 11.909/2009 (the Brazilian Gas Law).
The internal pipes in an industrial plant are not subject to this Resolution, with the exception of port pipes.
In addition, the draft Resolution also allows the assignment of the authorisations granted under its terms, with the prior written permission of ANP, provided that the new grantee also meets the requirements therein.
The interested parties may submit their comments within the public consultation period, which will end on February 3, 2015. A public hearing is scheduled for March 11, 2015, beginning at 2 pm and ending at 5 pm.
