On October 14, 2016, Commerce issued a final rule (81 Fed. Reg. 70,933) amending the EAR’s requirements for reporting boycott-related requests. Before this rule, activities undertaken by US persons in furtherance of an unsanctioned foreign boycott could only be reported via US mail or FedEx. Now, any action that has the effect of supporting a restrictive trade practice or boycott fostered by a foreign country can be reported via electronic means through the Office of Antiboycott Compliance (OAC). This is an important development insofar as it provides an additional mechanism, and thereby makes reporting easier, for boycott-related requests. In addition, the rule enhances the procedural efficiency of reporting boycotts or any practice that fosters restrictive trade practices imposed by a foreign country.

The final rule became effective October 14, 2016.
